Agreement version 2026-07-23. Read carefully — these terms are binding on approval. Circumventing the Marketplace can trigger significant financial penalties.
1. Platform fee (25%)
OwnSig charges a platform fee of 25% of the gross amount of every sale, quote acceptance, or renewal transacted through the OwnSig Marketplace (or attributed to a Marketplace introduction). The fee is deducted before remittance; you receive the net. Fee rate is frozen per purchase at the then-current partner rate (default 25% / 2500 bps).
2. Marketplace exclusivity for introduced buyers
For any customer introduced to you via the OwnSig Marketplace (including clicks, requests, tickets, or purchases), you agree to process all related fees for that engagement — and any substantially similar follow-on work within 24 months — through the Marketplace billing path, not offline invoices that bypass OwnSig.
3. Direct-business / circumvention penalties
If you solicit, accept, or fulfill paid work from a Marketplace-introduced customer outside OwnSig billing (including redirecting them to pay you directly to avoid the platform fee), OwnSig may: (a) suspend or terminate your partner account; (b) withhold pending remittances; and (c) assess liquidated damages equal to three times (3×)the platform fees that would have been due on the circumvented transaction(s), plus recovery of OwnSig's reasonable investigation and collection costs. You acknowledge these amounts are a reasonable pre-estimate of harm from fee avoidance and marketplace trust damage, not a penalty for its own sake.
4. Scores, clicks, and audits
OwnSig tracks listing clicks and purchases, and publishes a public seller score from verified buyer ratings. You consent to display of aggregate scores next to your listings. OwnSig may audit remittances and request evidence of customer billing paths for Marketplace-introduced accounts.
